Introduction

Operations are now sending letters in the form of the documents below to sales people when, in Operations view, the branding on the goods features a trademark which may cause delays when passing through CN Customs.
Operations will add the company logo, VP image and date.
Sales need to add the details of the customer contact signing the letter and then send to the customer as a PDF. They will receive an email from Operations in each case where the letter is needed:



Dear Sales,

Please insert your customer's information at the bottom of the attached form and convert to PDF. Then as per Management's instruction, please email the document to your contact requesting their co-operation to sign the authorisation letter. when you receive a signed copy in return, please email to logo@flashbay.com

*Please Note*
It is vital that these requests are not ignored by sales as a single issue with Customs over one logo holds up an entire shipment of hundreds of orders.

If Chinese Customs inspect the shipment and object to the use of the logo then the only mechanism by which the goods can be released is with a suitable authorisation letter from the logo owner.

How to deal with customers that are unable to provide the Authorisation letter?

If the customer is unable to provide the letter in advance of shipment then they must confirm via email that they will assist in obtaining the letter in the event that it is required by China customs and will hold Flashbay fully harmless in the event that the order is delayed due to the letter not having been provided in advance as requested.

For such cases please use this template to explain to customer:

"Please confirm by way of response that you understand that if you do not assist us with obtaining the letter of authorisation in the event that it is required by China customs, you will hold Flashbay fully harmless if, as a result, the order is delayed due to the letter not having been provided in advance as requested.

Please also confirm that you understand that the letter of authorisation from the trademark owner is the only mechanism by which the goods can be released, and if this is not provided after the customs seizes the order you will not hold us accountable for this due to your failure to provide the letter.

Please respond by confirming that you fully understand and agree with the above"
